The theme of the URISA-OC Winter event workshop is GIS and the Law - Key Issues for GIS Professionals - An Introduction to Best Practices.  

Come and join your colleagues in our first full day workshop to develop a better understanding of the numerous legal issues that have come to the forefront within the GIS community- responsibility, liability, ownership, licensing etc.  Lou Milrad, Associate Counsel with Miller Thomson will be the course leader.  As a member and past president of URISA-OC Lou Milrad will leverage his extensive legal experience and contributions to URISA-OC to introduce and clarify best practices and the legal issues impacting the GIS community.

  • Brief overview of the concept of intellectual property
  • Discussion on IP rights that apply to work done by GIS Professionals

10:35- 11:00:  Ownership Rights and Licensing

  • The existing state of copyright protection for plans of survey, maps, digital data and databases or compilations of survey information
  • Government initiatives that may affect existing licensing agreements with industry or government
  • Joint ventures – sharing technologies
  • Innovation - protecting copyright of value added features

11:00 – 12:00: Interactive Discussions

  • Avoiding Liability
  • Duty and standard of care to parties in the context of a license agreement
  • Liability risks from works placed in the public domain
  • Liability risks in the case of shared technologies: navigation systems manufacturers using maps prepared by third parties
  • Suggestions for Developing a Best Practices Model
  • Definition of the concept of Best Practices
  • Discussion on retainers and disclaimers
  • Limitations of Liability
  • Developing industry standards for preparation of files
